What happens after I Instruct you?

To ensure a smooth and efficient process, our team will Issue the Notice of Enforcement as soon as possible, then attend after this expires 14 clear days.

Taking Control of Goods

On attending the debtor’s premises, our Bailiff / Enforcement Agent will attempt to take control of goods or collect your arrears and our charges.

There are several options available at this stage, including entering into a Controlled Goods Agreement, securing goods on the highway, locking up goods on part of the premises, or removing goods to storage ready for sale.

Enforcement Process

After the Notice of Enforcement is issued, the debtor has 14 clear days to pay in full before our Bailiff / Enforcement Agent attends to take control of goods.

If the debtor fails to pay, our agent will attend the premises to recover the outstanding rent arrears and our fees.

The enforcement process typically takes around 19 days from posting the Notice of Enforcement, allowing for delivery time, or 16 days if served personally. Our team will keep you updated throughout the process, ensuring you’re informed every step of the way.

Who Bears the Costs?

Free from the burden of upfront costs, landlords can recover the expenses of using CRAR from the debtor (tenant) if the recovery is successful.

Associated with the CRAR process, the enforcement costs are typically recovered from the tenant as part of the debt recovery process. This means that landlords can benefit from using CRAR without incurring significant upfront expenses. This can be a significant advantage for landlords seeking to recover rent arrears.

By following these steps, you'll be well-prepared to initiate the CRAR process and recover your commercial rent arrears quickly and efficiently.
